Employer Nominated Visas


This particular Visa allows Australian businesses to employ a skilled person from outside Australia in a skilled job. A holder of subclass 457 visa can live and work in Australia for up to four years along with their family and also travel in and out frequently.


One can apply if they are sponsored by an employer to fill in the required vacancy.

One who is proficient enough in English Language.

Eligible for any relevant license or registration required for the vacancy.

Have skills and qualification for the same position.


This subclass visa has three subcategories like Business innovation stream Visa, Business Investor Stream Visa and Business talent Visa


The Business Innovation and Business Investor stream visas are valid for four (4) years with potential to become permanent, and the Business Talent visa is for permanent residency.


The subclass 457 visa is for skilled workers from outside Australia who have been sponsored and nominated by a business to work in Australia on a temporary basis.


A business can sponsor a skilled worker if they cannot find an appropriately skilled Australian citizen or permanent resident to fill a skilled position listed in the Sponsored Occupation List

There are three stages for this visa
1) When the employer applies to be a sponsor
2) The employer nominates a position in his business
3) When the employee is applying for a visa


On the same time the application for the three stages can be filed.

When the Employer applies to be a sponsor
This is when the employer applies to become a sponsor and it can be done through two arrangements.
First when the employer negotiates with the government of Australia for a labour agreement.
Secondly for applying a standard business sponsorship.
It is not a mandate that the employer needs to have his business in Australia, can have it outside from another place as well. When the application of the sponsorship is approved then the business becomes an approved sponsor which is valid for three years.

When the nomination for a position in the business is done by the employer
After the sponsored is approved then he is eligible to nominate a skilled worker to fill in the vacancy. The skilled worker has to be paid the market salary for the same position in Australia. The position also should be in the eligible occupation. This visa is eligible for one year unless the sponsorship becomes dormant.

When the employee applies for a visa
Here the skilled worker applies for a visa to work in Australia. They require a sponsor for the application to be valid on the subclass 457. This visa is valid for this subcategory for 4 years.

The purpose of the sponsorship stage is to confirm that the business wanting to employ the skilled worker:

    • is a lawfully operating business
    • has no adverse information about it or any of its directors
    • meet the department's training requirements (Australian businesses only).
      Australian businesses must also demonstrate their commitment to employing local labour and non-discriminatory employment practices.
      As an approved sponsor, you can nominate an unlimited number of subclass 457 visa applicants (or visa holders) as long as your standard business sponsorship or labour agreement is valid.
